Purpose of post:
The Commercial and Contracts Branch sits within the Strategic Road Network (SRN) Division but provides contract and commercial support to the whole of Transport and Digital Connectivity Directorate. The Head of Commercial and Contracts leads this branch by providing advice on all commercial and contracting activities on SRNs projects.
Key Tasks:
- Support and provide day to day contract, commercial, risk and procurement advice to the SRN division on the delivery of capital and maintenance projects with an annual budget of £200m - £300m.
- Provide advice to project teams on drafting, implementing and administering NEC forms of contract.
- Continual update and revisions to the SRN divisions’ NEC model contract documents to ensure they align with legislation, best practise and current WG policies (including Manging Welsh Public Money and Llwybr Newydd: the Wales Transport Strategy, Wales Procurement Policy Statement).
- Implement carbon reduction strategies and incentives into SRN contract in line with WG policies.
- Implement appropriate governance structures to ensure optimum contract performance and value for money.
- Review, analyse, report and make recommendations on SRN commercial and contract risks.
- Provide advice and leadership on any contractual disputes with the supply chain through negotiations or dispute resolution processes.
- Work with legal experts to robustly defend contractual claims made against WG.
- Understand national and global markets and how they can influence contracts, commercial and procurement strategies.
- Work alongside the Construction and Facilities Category (CFC) of the Commercial Procurement Directorate in the practical delivery of all Transport related procurement activity
- In working with the CFC embed current best practices and procedures to ensure compliance with the Public Procurement Act (2023), Social Partnership and Public Procurement Act (2023) or any previous applicable legislation. (e.g. Public Contracts Regulations 2015)
- Review and provide advice to the WGs Trunk Roads Agents on their contract and commercial management processes.
- Together with the CFC, develop and implement a procurement and supply chain strategy for the delivery of the SRN division’s Major Asset Renewals Program valued at over £700m.
- Develop and implement an updated Procedures Guidance for the management and delivery of projects in the SRN division.
- Develop, implement, monitor and analyse key performance indicators to ensure the supply chain partners are meeting their targets and objectives.
- Develop and maintain strong relationships with the supply chain network to understand market trends and forces and ensure WG receive a quality service and value for money.
- Develop and maintain strong relationships with the wider public sector procurement sector across Wales
- Through engagement with the Government Commercial Function (GCF) develop, maintain and apply practical knowledge of UK Government Commercial Contract management tools, techniques and training.
- Provide advice on the management and control of the acquisition of land and property that may be required by the development, operation and maintenance of the Welsh Government’s SRN.
Hybrid Working:
Welsh Government have a hybrid working model based on being in your contracted office when there is a business requirement or when it suits your individual preference.
