We are seeking an experienced IR35 expert for a Government Department to provide technical guidance on IR35 requirements. There will not be a need to make any formal assessments on the IR35 status but more to provide a deep dive on several hundred assessments already made/completed by the department to ensure correct outcomes and application of IR35.
The successful candidate will work closely with our procurement, legal, and HR teams to ensure contractor engagements are correctly classified and compliant with HMRC regulations. This will involve looking through contracts and statements of work and interviewing multiple stakeholders.
Key Responsibilities:
- Conduct detailed reviews of existing and new contractor agreements across multiple programmes
- Provide expert assessment on IR35 status determinations (inside/outside IR35).
- Evaluate working practices, contract terms, and operational realities against IR35 case law and HMRC CEST tool guidance.
- Identify risk areas and recommend corrective actions or contract adjustments.
- Draft or refine Status Determination Statements (SDSs) with supporting rationale.
- Advise stakeholders on changes to ensure ongoing compliance.
- Support internal training or workshops to raise awareness of IR35 obligations.
- Stay current on legal and regulatory developments related to off-payroll working rules.
Required Skills & Experience:
- Proven track record in IR35 compliance, particularly in the public sector or government setting.
- Strong understanding of the Off-Payroll Working Rules (Chapter 10, ITEPA 2003).
- Experience interpreting and advising on complex contractual and operational arrangements.
- Familiarity with public sector procurement frameworks and contractor engagement models.
- Excellent written and verbal communication skills, especially in drafting SDSs and compliance reports.
- Ability to work independently and manage multiple contract reviews simultaneously.
- Relevant legal, tax, or compliance qualification preferred but not essential.
Preferred Qualifications:
- Legal, tax, or compliance certification (e.g., CTA, ACA, LLB, or equivalent).
- Familiarity with HMRC’s CEST tool and tribunal decisions.
- Experience liaising with or advising government departments or agencies
